Terms of Use

You must be at least 16 years old (EU/EEA) or 18 years old (India and most other jurisdictions) to use the Service. PraakTark offers three account types:

• Individual — candidates preparing for interviews.
• Company — employers running AI-assisted candidate interviews.
• College / TPO — training and placement offices managing student cohorts.

You agree to provide accurate registration information and to keep it current. You are responsible for all activity under your account and for safeguarding your credentials.

PraakTark provides AI-assisted interview practice, candidate assessment, and related hiring workflow tooling. Features, limits, and pricing may change. We may add, modify, or remove features at our discretion, and will give reasonable notice of material adverse changes to paid plans.

Company free trials are capped at a small number of candidate interviews per role and per team, as enforced by the Service. Trial limits exist to prevent abuse and may change without notice.

You agree NOT to:

• Scrape, crawl, mirror, or bulk-export the Service except via features we expose.
• Resell, sublicense, or commercially redistribute AI outputs generated by the Service.
• Use the Service to harass, defame, or unlawfully discriminate against candidates.
• Reverse-engineer, decompile, or attempt to extract source code, model weights, or prompts.
• Upload malware, illegal content, or personal data of third parties without lawful basis.
• Create multiple accounts to evade free-trial or credit limits, or otherwise abuse referral and credit systems.
• Interfere with the Service’s security, integrity, or rate limits.

We may suspend or terminate accounts that violate these rules.

The Service uses large language models and other AI systems to generate questions, feedback, summaries, scores, and recommendations. AI output is probabilistic and may be inaccurate, incomplete, biased, or out of date. AI output is NOT a hiring decision, employment recommendation, legal advice, medical advice, or guarantee of any outcome (including selection, job offer, salary, or job performance). You are solely responsible for any decision you make based on AI output, including final hiring decisions, which must comply with applicable equal-opportunity and anti-discrimination law in your jurisdiction.

When a Company or TPO account invites candidates to interviews or cohorts, that account acts as an independent data controller (or joint controller, where applicable) for the candidate personal data it collects through the Service. You represent and warrant that you have a lawful basis to collect, process, and transfer candidate data to PraakTark, and you agree to:

• Provide candidates with appropriate privacy notice and obtain any required consent.
• Honour candidate rights requests (access, deletion, etc.) and pass them to us where we host the data.
• Not collect special-category personal data unless strictly necessary and lawful.
• Sign our Data Processing Addendum (DPA) where required by GDPR Art. 28 or DPDP §8(5). Contact privacy@praaktark.com.

Our handling of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, PraakTark disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that AI output will be accurate, complete, or suitable for any decision.

To the maximum extent permitted by law, PraakTark’s aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the fees you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 10,000 / USD 100. In no event shall PraakTark be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost goodwill, or hiring outcomes.

You agree to indemnify and hold harmless PraakTark, its affiliates, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your content, your use of the Service in violation of these Terms or applicable law, or your hiring or candidate decisions.

You may close your account at any time from Settings → Privacy, which also triggers deletion of your personal data per the Privacy Policy. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, threatened the security or integrity of the Service, or are required by law. On termination, surviving provisions (IP, disclaimers, liability cap, indemnity, governing law, dispute resolution) continue in effect.

Before account closure, you may export your data at any time from Settings → Privacy. We retain data after closure only for the limited periods described in the Privacy Policy.

We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 14 days before they take effect (or as soon as reasonably practicable for changes required by law). Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction, subject to any mandatory consumer-protection rights in your country of residence. For users in the EU/EEA, nothing in these Terms excludes mandatory local consumer rights.

Grievances may be sent to: privacy@praaktark.com. We acknowledge within 72 hours and resolve within 30 days as required under the DPDP Act 2023 and the IT Rules.
